In principle, tracker.ch AG processes and stores your personal data only to the extent necessary to fulfill the contract. 4 For what purposes and on what legal basis do we process personal data?

tracker.ch processes personal data in accordance with Swiss data protection law. In addition, we process personal data in accordance with the following legal bases, insofar as the GDPR is applicable:

Art. 6 para. 1 lit. b GDPR for the processing of personal data necessary for the performance of a contract with the data subject and for the implementation of corresponding pre-contractual measures.
Art. 6 para. 1 lit. c GDPR for the processing of personal data necessary for compliance with a legal obligation to which we are subject under any applicable EU law or under any applicable law of a country in which the GDPR is applicable in whole or in part.
Art. 6 para. 1 lit. d GDPR for the necessary processing of personal data to protect the vital interests of the data subject or another natural person.
Art. 6 para. 1 lit. f GDPR for the necessary processing of personal data to protect our legitimate interests or those of third parties, except where such interests are overridden by the fundamental freedoms and rights and interests of the data subject. Legitimate interests are, in particular, our business interest in being able to provide our website, information security, the enforcement of our own legal claims and compliance with Swiss law.

First and foremost, the processing takes place in the context of the fulfillment of a contract in which you are involved as a user and contracting party or in which an affiliated natural or legal person is involved. 5. where is the data processed?

tracker.ch processes personal data on its own servers in Switzerland. As some data is also processed with the involvement of third-party servers, it cannot be ruled out that personal data may also be processed on servers outside your country of residence. If we transfer data to a country without adequate legal data protection, we ensure adequate protection as provided for by law by using appropriate contracts or rely on the legal exceptions of consent, contract execution, the establishment, exercise or enforcement of legal claims, overriding public interests, published personal data or because it is necessary to protect the integrity of the data subjects. 6 How long is personal data stored?

tracker.ch processes and stores your personal data for as long as is necessary for the fulfillment of its contractual and legal obligations or otherwise for the purposes pursued with the processing, i.e. for example for the duration of the entire business relationship (from the initiation, processing to the termination of a contract) as well as beyond that in accordance with the statutory retention and documentation obligations. It is possible that personal data will be stored for the period in which claims can be asserted against tracker.ch and insofar as tracker.ch is otherwise legally obliged to do so or legitimate business interests require this (e.g. for evidence and documentation purposes).   • In some cases, personal data is passed on to external, trustworthy contractors who provide services for tracker.ch, such as IT and hosting service providers, marketing service providers, providers of communication and printing services, debt collection companies, search services, fraud prevention agencies, credit rating agencies and other contractors. 8. which third-party services are used by tracker.ch?

tracker.ch uses various services from Google Inc ("Google") from the USA.
These include Google Analytics and Google Maps.
The website and apps use Analytics to analyze user behavior,

The aforementioned services of the American Google use cookies, among other things, and data is transferred to Google in the USA, whereby tracker.ch assumes that no personal tracking takes place in this context solely through the use of our website. Google has undertaken to guarantee appropriate data protection in accordance with the US-European and US-Swiss Privacy Shield. Further information can be found in Google's privacy policy.
tracker.ch also uses plug-ins from social networks such as Facebook and YouTube on its website. This is visible to you in each case (typically via corresponding icons). tracker.ch has configured these elements so that they are deactivated by default. Persons about whom tracker.ch processes personal data have the right to lodge a complaint with a competent supervisory authority for data protection. The supervisory authority for data protection in Switzerland is the Federal Data Protection and Information Commissioner (FDPIC).

10. how secure is your data?

tracker.ch has taken appropriate technical and organizational measures to prevent unauthorized or unlawful access to the personal data you have provided to us. Since complete data security cannot be guaranteed for communication by e-mail, instant messaging or similar means of communication, we recommend that you choose a secure alternative for sending particularly confidential personal data.

tracker.ch endeavors to give you the technically possible access to your personal data. If it is inaccurate, we will endeavor to give you the opportunity to update or remove it quickly, unless we need to retain it for legitimate business or legal purposes.

tracker.ch endeavors to provide the services in a way that protects personal data from accidental or willful destruction. For this reason, we may not immediately delete any remaining copies of personal data that you have deleted from our services from our active servers or remove this personal data from our backup systems, e.g. if we keep records of payments and previous orders that must be retained in accordance with the company's accounting principles.
